1. About Us
Welcome to Comfortably Spun Records, an independent UK online record shop specialising in pre-owned and collectible rock vinyl records.
Our collection focuses on classic rock, blues rock, heavy metal, progressive and psychedelic rock, punk, new wave, indie, alternative and grunge.
These Terms and Conditions govern the purchase of products from our website.
Trading name: JH Trading T/A Comfortably Spun Records
Legal trader: John Hartshorn
Business address: 37 West Ella Way, Kirk Ella, Hull, East Yorkshire HU10 7LN
Contact email: [email protected]
Telephone: 07946176825
Comfortably Spun Records operates exclusively online. We do not have a physical retail shop or offer customer collections.
By placing an order through our website, you agree to these Terms and Conditions. Nothing in these terms affects your statutory consumer rights.
2. Our Products
We specialise primarily in pre-owned vinyl records, including:
-
12-inch LP albums
-
7-inch vinyl singles
-
12-inch vinyl singles
-
Original and early pressings
-
Picture discs and coloured vinyl
-
Limited editions and collectible releases
Unless expressly stated otherwise, vinyl records offered for sale are pre-owned.
Our stock consists predominantly of individual, second-hand items. Quantities are therefore usually limited to one copy of each listed record.
We make reasonable efforts to ensure that product descriptions, photographs, prices and availability are accurate.
3. Vinyl Record Grading
All pre-owned vinyl records and sleeves are individually inspected and visually graded in accordance with the recognised Goldmine Grading Standard.
Our grading descriptions may include:
Mint (M): An item in absolutely perfect condition, generally unplayed and without defects. We use this grade only where fully justified.
Near Mint (NM or M-): An item showing little or no visible evidence of handling or wear.
Very Good Plus (VG+): An item showing some signs of previous use but remaining in well-cared-for condition.
Very Good (VG): An item showing noticeable signs of handling, use or wear.
Good Plus (G+) / Good (G): An item showing more significant signs of use or wear.
Fair (F) / Poor (P): An item with substantial visible wear or defects, clearly identified in its description.
The vinyl record and its sleeve are graded separately wherever applicable.
Important: All pre-owned vinyl records are visually graded only and are not play-tested.
Visual grading assesses the observable condition of a record but cannot guarantee that it will play without surface noise, clicks, pops, skips or other playback imperfections.
Where we identify visible scratches, marks, warping, sleeve damage, writing, stickers or other noteworthy defects, we aim to disclose these in the product description.
Our grading represents our reasonable assessment of the item's condition at the time of inspection.
Nothing in this section excludes or limits your statutory rights where goods are not as described, not of satisfactory quality or otherwise fail to meet applicable legal requirements.
4. Product Photographs and Descriptions
We photograph individual pre-owned records so that customers can see the actual items offered for sale.
All product photographs show the actual item being sold, unless an exception is expressly identified in the listing.
Photographs form part of the product information and should be considered alongside the written description and condition grading.
We aim to represent colours, labels, sleeves and visible condition accurately. However, differences in screen settings and lighting may affect how colours appear.
Where relevant and reasonably identifiable, descriptions may include:
-
Artist and album or single title
-
Record label and catalogue number
-
Country of manufacture
-
Pressing or release year
-
Matrix and runout information
-
Vinyl and sleeve condition
-
Original inserts, posters or printed inner sleeves
-
Known defects or missing components
Customers are encouraged to review the full description and photographs before purchasing.
5. Original Pressings and Collectible Editions
Many records are available in multiple pressings, reissues and variations.
We take reasonable care when identifying original pressings, early editions, label variations and other collectible characteristics.
Identification may be based on catalogue numbers, labels, sleeve details, matrix and runout markings, and available reference information.
Where an edition cannot be established with reasonable confidence, we will avoid representing it as a confirmed original or first pressing.
Any information about rarity, collectability or pressing history is provided in good faith.
If you require clarification about a particular edition, please contact us before placing your order.
6. Prices and Availability
All prices are displayed in pounds sterling (GBP).
The total price payable, including applicable delivery charges, will be presented before you confirm your purchase.
Any applicable taxes will be handled according to our trading and tax status and the relevant legal requirements.
Products are subject to availability.
Because many records are one-off items, an album may become unavailable after it has been purchased.
In the unlikely event that an item is unavailable after an order has been placed, we will contact you and arrange a refund of any payment received for that item.
We reserve the right to correct obvious pricing or listing errors. If an error affects an order, we will contact you before proceeding and give you the opportunity to accept the corrected details or receive a refund.
7. Placing an Order
Orders are placed through the secure checkout facilities provided by our e-commerce platform, Freewebstore.
When placing an order, you must provide accurate information necessary for payment, delivery and communication.
After submitting an order, you should receive an electronic acknowledgement.
An order acknowledgement confirms receipt of your order but does not necessarily constitute acceptance.
A contract of sale is formed when we confirm acceptance of your order, normally through an order acceptance or dispatch confirmation.
We may decline an order where there is a genuine issue involving stock availability, payment authorisation, delivery restrictions or an obvious listing error.
Where payment has already been received for an order we cannot fulfil, the relevant amount will be refunded.
8. Payment
Payment is made using the payment methods available through our Freewebstore checkout.
Available payment options will be displayed during checkout.
Payment must be successfully authorised before goods are dispatched.
Payment processing is handled through the arrangements provided by Freewebstore and its supported payment service providers.
We do not intentionally store customers' complete payment card numbers or card security codes in our own business records.
9. Cleaning and Preparation
Every pre-owned vinyl record is carefully cleaned before dispatch using an appropriate record-cleaning process.
Records are then inspected and prepared for packaging.
Cleaning is intended to remove surface dust and contamination where reasonably possible. It does not guarantee the removal of scratches, pressing defects, groove wear or other permanent imperfections.
Cleaning does not constitute play-testing.
10. Packaging
We take particular care when packaging vinyl records for delivery.
Orders are securely packaged using suitable protective materials and rigid record mailers or equivalent protective packaging.
Where appropriate, records may be removed from their outer sleeves during packing to reduce the risk of seam splits in transit.
Additional protection may be used for higher-value or particularly delicate items.
Our aim is to ensure that every order reaches its destination in the condition described.
11. Delivery
We primarily use Royal Mail for UK deliveries.
Available delivery services and their charges will be displayed during checkout.
Where offered, customers may select between Royal Mail Tracked 48 and Royal Mail Tracked 24.
Delivery estimates are not guaranteed delivery dates.
We aim to dispatch orders promptly following successful payment, normally within two working days, unless otherwise stated.
Working days exclude Saturdays, Sundays and public holidays.
If we cannot dispatch an order within the stated period, we will contact you where appropriate.
Unless a different delivery period has been agreed, goods will be delivered without undue delay and within 30 days of the contract being made, in accordance with applicable consumer law.
Where delivery is significantly delayed, customers retain their statutory rights.
12. Delivery Addresses and Failed Deliveries
Customers are responsible for providing a complete and accurate delivery address.
If you discover an address error, please contact us as soon as possible.
We cannot guarantee that an address can be changed after dispatch.
Where an order is returned because the customer supplied an incorrect address or failed to collect it, we will contact the customer to discuss redelivery or any applicable refund.
Any additional delivery charges will be explained before redelivery is arranged.
Nothing in this section removes our responsibility for delivery where the law places that responsibility on us.
13. Responsibility for Goods in Transit
We remain responsible for goods until they come into your physical possession, or the physical possession of a person you have identified to receive them, except where applicable law provides otherwise.
If an order arrives damaged, is lost in transit or does not arrive, please contact us promptly so that we can investigate and arrange an appropriate remedy.
Where goods are lost or damaged before delivery, your statutory rights remain unaffected.
14. Your Right to Cancel
If you purchase goods from us online as a consumer, you will normally have the right to cancel your order within 14 days without giving a reason.
For a single delivery of goods, this cancellation period normally expires 14 days after the day on which you, or someone you nominate, receives the goods.
For orders delivered separately, the period normally runs from receipt of the final item.
To exercise your right to cancel, you must inform us of your decision by a clear statement, such as an email or written notification.
You may use the model cancellation form provided in Section 22, but you are not required to do so.
You must send the goods back without undue delay and no later than 14 days after informing us of your decision to cancel.
You are responsible for the direct cost of returning goods following a change-of-mind cancellation, unless we have agreed otherwise.
You should take reasonable care of goods while they are in your possession.
We may make a lawful deduction from a refund where goods have diminished in value because of handling beyond what is necessary to establish their nature, characteristics and functioning.
15. Refunds Following Cancellation
Where you exercise your statutory right to cancel, we will refund payments received for the cancelled goods.
We will also refund the original standard delivery charge where required by law.
If you selected a more expensive delivery service than our least expensive standard delivery option, we are not required to refund the additional cost of that upgrade.
Refunds will be made without undue delay and within the applicable statutory timescales.
For returned goods, we may withhold the refund until we receive the goods or you provide evidence that you have sent them back, whichever occurs first.
Refunds will normally be made using the original payment method unless otherwise agreed.
We will not impose a refund fee.
16. Faulty, Damaged or Misdescribed Goods
We want every customer to receive the record they ordered, in the condition reasonably expected from its description and grading.
Under the Consumer Rights Act 2015, goods supplied by a trader must be of satisfactory quality, fit for purpose and as described, taking account of their age, price, condition and other relevant circumstances.
These rights also apply to second-hand goods.
If an item is faulty, damaged or materially different from its description, please contact us with your order details and an explanation of the problem.
Photographs may assist us in resolving the issue, although we will not make the provision of photographs an absolute condition of exercising your statutory rights.
Depending on the circumstances and your statutory rights, an appropriate remedy may include a refund, repair or replacement.
As many of our records are individual collectible items, an identical replacement may not be available.
Where goods fail to conform to the contract, we will meet any return costs for which we are legally responsible.
Visual grading and the absence of play-testing do not exclude or restrict your statutory consumer rights.
17. Returns Procedure
To request a return, please contact us using the details on our Contact Us page.
Include your order number, the item concerned and the reason for the return.
We will provide the appropriate return instructions and address.
Please package returned vinyl securely to minimise the risk of damage during transit.
Where reasonably possible, we recommend using suitable protective packaging and retaining proof of postage.
Customers should not send returns to an address other than the return address provided or published for that purpose.
18. International Orders
International delivery may be offered to selected destinations.
Where available, eligible destinations and delivery charges will be shown during checkout.
International customers may be responsible for import duties, customs charges and local taxes imposed by the destination country, unless expressly stated otherwise.
Any such charges are separate from our selling price and delivery charges.
Delivery times may be affected by customs procedures and international postal arrangements.
International consumers may have additional mandatory rights under the laws applicable to their purchases.
We do not exclude any rights that cannot lawfully be excluded.
19. Website Information and Availability
We make reasonable efforts to keep our website accurate, secure and available.
Occasionally, website content may contain typographical errors, technical issues or outdated information.
We may update product descriptions, prices, website content and available services as necessary.
We cannot guarantee uninterrupted website availability.
Nothing in this section affects rights arising from a completed contract or our legal obligations to customers.
20. Intellectual Property
The Comfortably Spun Records name, branding, original website text, photographs, graphics and other original content belong to us or are used with appropriate permission, subject to any third-party rights.
Product names, band names, album artwork, record labels and trademarks remain the property of their respective owners.
Their appearance on our website is for the purpose of accurately identifying and describing genuine products.
Unless permitted by law or with our prior written consent, our original website content must not be reproduced or used commercially.
21. Liability and Consumer Rights
Nothing in these Terms and Conditions excludes or limits liability for:
-
Death or personal injury caused by negligence
-
Fraud or fraudulent misrepresentation
-
Breach of statutory consumer rights
-
Any other liability that cannot lawfully be excluded or restricted
We are responsible for losses caused by our breach of contract or failure to exercise reasonable care and skill where those losses are foreseeable.
We are not responsible for losses that are not reasonably foreseeable, except where the law provides otherwise.
These Terms and Conditions are intended for customers purchasing goods for personal use.
Nothing in these terms limits the remedies available under applicable consumer protection legislation.

24. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our business, website, services or applicable legislation.
Updated terms will be published on this page with a revised date.
Changes will not retrospectively alter the terms of an existing contract unless legally permitted and appropriately agreed.
25. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
If you are a consumer resident in another part of the United Kingdom, you retain the benefit of any mandatory consumer protections applicable in your place of residence.
